Advanced MSPB Law: Navigating Complex Issues – July 14-16, 2026

Do you want to take your knowledge and understanding of MSPB law to a new level? Want to confidently address the new and emerging Federal employment law issues, and the existing knotty scenarios, that challenge even the most experienced advisors?

FELTG’s three-day Advanced MPSB Law: Navigating Complex Issues is an in-depth, highly interactive virtual training event that will not only meet all those needs but also help you reach the top of your game.

During Advanced MSPB, participants will move beyond the foundations discussed in MSPB Law Week and explore high-level discussions of effective strategies and techniques for managing disciplinary and performance issues, including those that cross over with EEO.

Tuesday, July 14: Discipline Issues

Take a deep dive into discipline. This course will provide effective strategies and techniques for managing disciplinary challenges. We’ll start with a discussion of the nexus requirement and cover the complex topics, such as comparator employees and alternative discipline.

Learning objectives

  • Identify the various ways agencies can demonstrate nexus for off-duty misconduct.
  • Use progressive discipline effectively – and know when it’s not warranted.
  • Draft appropriate documents for the alternative discipline.

Wednesday, July 15: Performance and Reasonable Accommodation Challenges

From performance improvement periods to requests for accommodation, this class will include high-level discussions on performance challenges, including those involving employees working remotely as a reasonable accommodation. Plus, we’ll discuss OPM’s new performance guidance and what it means for your agency’s policies and performance systems.

Learning objectives

  • Write legally-sufficient performance standards.
  • Identify new OPM requirements for performance systems and accountability.
  • Handle reasonable accommodation challenges, including telework requests.

Thursday, July 16: Probationary Challenges; Mixed Cases; RIFs

In this final day, we’ll tackle the perplexing topics such as mixed cases, and offer effective strategies and techniques for managing challenges related to an employee’s probationary or trial period status. Plus we’ll cover the complex area of mixed case appeals, and we’ll close out with a discussion on Reduction in Force (RIF) regulations.

Learning objectives

  • Identify the legal definitions for probationary and trial periods.
  • Determine which individuals have MSPB appeal rights – and which do not.
